What conveyancing checks do I need when buying a house?

There are certain standard checks it always makes sense to carry out, as well as other more niche checks that may be worth considering depending on the type of property, its location and any particular local issues that may be cause for concern.

Standard conveyancing checks include:

Local Authority Searches – Looking for issues such as whether the property is listed or in a conservation area, as well as whether there are any new property developments, roads or other projects planned for the area.

Water and Property Searches – To find out who is responsible for the property’s sewerage, drains and water supply, as well as whether any public sewers or drains run under the property.

Environmental Searches – Looking for issues connected to previous land use that might create a risk to the property or your health, e.g. from subsidence, flooding or land contamination.

Can I pull out of buying a house if a problem is found?

The sale of a property only becomes legally binding once contracts have been exchanged, which takes place after conveyancing checks have been carried out. Up until this point, either party can pull out or attempt to renegotiate the agreed sale price is they wish.

This means that should conveyancing checks or a building survey turn up any issues with the property, you can ask for the sale price to be reduced to reflect this or pull out of the purchase entirely if you wish.

However, once contracts have been exchanged, you are legally committed to buying the property at the agreed price and could lose your deposit and face potential legal action if you attempt to pull out.
